Construction law can be complex and construction contracts come in all shapes and sizes, although there are a number of issues which seem to crop up time and time again. The practical effects of these issues are as varied as the contracts themselves. But the headaches are usually serious: banks who refuse to accept the contracts as security for development loans, difficulties enforcing the contract terms or working out which part is at fault, construction packages which contain shortcomings or are defective with the result that the development is worthless or becomes very diffcult to market effectively, unwittingly breaching the contract terms, or losing the court battle. These problems are never intended by the parties but they are all too frequent and can be easily avoided with a little care and foresight. This seminar takes a practical look at seven of the most frequently encountered types of problem, throwing a spotlight on a number of legal issues with the emphasis very much on prevention rather than cure.
